Welcome to Astron Marketer. In these Terms of Service, “Astron Marketer,” “we,” “us,” and “our” refer to the operator of this online store. We operate this website and its related content, features, tools, products, and services (collectively, the “Services”). Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer the Services.

These Terms of Service, together with the policies linked in them, explain the terms that apply when you visit or use our Services or purchase products from us. Please read them carefully, particularly the sections about orders, shipping, disclaimers, and liability.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

These Terms do not limit any consumer rights that cannot lawfully be excluded under applicable law.

Section 1 — Access and account

You must be legally capable of entering into a binding contract under applicable law to place an order. If you allow a minor to use a device you own or manage to access the Services, you are responsible for supervising that use.

You may need to provide information such as your email address, billing details, payment information, and delivery address to use certain features or place an order. You agree to provide information that is accurate, current, and complete, and to update it when necessary.

You are responsible for keeping your account credentials secure and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without authorization.

Section 2 — Products and product information

We make reasonable efforts to display product descriptions, images, colours, dimensions, and other details accurately. Actual product appearance may vary slightly because of screen settings, lighting, manufacturing variations, or packaging changes. Images are intended to help you understand the product and should be read alongside the written description and specifications.

Product descriptions, availability, and prices may be updated from time to time. Any change will not alter an order that we have already accepted except where required or permitted by law or agreed with you.

Section 3 — Orders and cancellations

Placing an order is an offer to purchase the selected products. An order is accepted when we send an order confirmation or otherwise confirm acceptance. We may decline or cancel an order where reasonably necessary—for example, if a product is unavailable, a payment is not authorized, an obvious pricing or listing error has occurred, or we reasonably suspect fraud or misuse. If we cancel an order after payment, we will arrange a refund of the amount paid for the cancelled order through the applicable payment method, subject to payment-provider procedures.

Please check your cart, delivery address, contact details, and selected products before completing checkout. If you need to request a cancellation or change, contact us as soon as possible at astronmarketer@gmail.com. We cannot guarantee a change or cancellation after an order has been processed or dispatched.

Returns, replacements, and refunds are handled under our REFUND/RETURN POLICY. Nothing in these Terms removes remedies available to you under applicable consumer law.

Unless we expressly agree otherwise, products are offered for personal or household use and not for unauthorized resale or commercial distribution.

Section 4 — Prices, taxes, and payment

The price and any applicable shipping charges shown at checkout are the amounts applicable to your order at the time you place it. Prices and promotions may change for future orders. If a promotion has separate terms, those terms apply to that promotion to the extent they do not conflict with applicable law.

Before you submit an order, review the order total and any shipping charges or taxes shown at checkout. We will disclose applicable charges as required by law. If an obvious pricing or listing error affects an order, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order. If the order is cancelled after payment, we will arrange a refund of the amount paid.

Payments are processed through the payment methods made available at checkout. You confirm that you are authorized to use the selected payment method and that the information you provide is accurate.

Section 5 — Shipping and delivery

We deliver to the locations and serviceable pin codes displayed or accepted at checkout. Delivery dates and timelines are estimates unless we expressly confirm a guaranteed delivery date. Delays can occur because of courier operations, weather, service disruptions, incorrect address details, or other circumstances.

Please ensure that your delivery address and contact details are correct. If a parcel appears damaged, tampered with, incomplete, or incorrect, document the issue and contact us promptly at astronmarketer@gmail.com. If the courier offers an open-parcel inspection service, you may use it where available; it is not available for every shipment.

We will handle delivery issues, lost shipments, damage, and other order problems in accordance with our published policies and applicable law. Nothing in this section excludes rights or responsibilities that cannot legally be excluded.

Section 6 — Intellectual property

The content on the Services—including text, graphics, logos, photographs, videos, page design, and other materials—is owned by or licensed to Astron Marketer or the relevant rights holder and may be protected by intellectual-property laws.

You may use the Services for personal, lawful shopping purposes. Except where permitted by law or with prior written permission from the relevant rights holder, you must not copy, reproduce, modify, distribute, publish, sell, or commercially exploit content from the Services.

“Astron Marketer” and our associated branding may not be used without permission. Shopify and third-party names, logos, and marks belong to their respective owners. These Terms do not transfer ownership of intellectual property to you.

Section 7 — Third-party tools

The Services may provide access to tools or features operated by third parties. Those tools may be governed by the third party’s own terms and privacy practices. We do not control every aspect of third-party tools, but this does not limit any responsibility we have under applicable law.

Please review the relevant third-party terms before using an optional tool. We may add, change, or discontinue features of the Services from time to time.

Section 8 — Third-party links

Our Services may contain links to third-party websites or services. We provide these links for convenience and do not necessarily endorse or control the third-party content, products, or practices.

If you visit a third-party website or make a purchase from a third party, that interaction is governed by the third party’s terms and policies. Please review them before proceeding. This section does not exclude liability that cannot be excluded under applicable law.

Section 9 — Relationship with Shopify

Our store is hosted by Shopify, which provides the e-commerce platform used to offer the Services. Purchases made through this store are transactions between you and Astron Marketer, not Shopify. To the extent permitted by applicable law, Shopify is not responsible for the products sold by Astron Marketer or for the terms of transactions between you and Astron Marketer. Nothing in this section limits any rights you may have against a party under applicable law.

Section 10 — Privacy

Our collection and use of personal information is described in our PRIVACY POLICY. Shopify also processes certain information in connection with hosting and operating the store, as explained in Shopify’s applicable privacy documentation.

By using the Services, you acknowledge that information necessary to operate the store, process payments, fulfil orders, provide customer support, prevent fraud, and meet legal obligations may be processed by us, Shopify, and relevant service providers in accordance with the applicable privacy notices and law.

Section 11 — Feedback and reviews

If you submit a review, suggestion, or other feedback, you confirm that it is truthful to the best of your knowledge, relates to your genuine experience where presented as a customer review, and does not violate another person’s rights or any law.

You grant Astron Marketer a non-exclusive, worldwide, royalty-free permission to use, reproduce, display, and share feedback you submit for store operation and promotion, subject to applicable law and our Privacy Policy. We will not imply that you endorse a product or claim an experience you did not have.

We may moderate or remove feedback that we reasonably consider unlawful, fraudulent, abusive, irrelevant, misleading, or infringing, or that otherwise violates these Terms. We are not required to publish every submission.

Section 12 — Errors and omissions

We try to keep store information accurate and current, but occasional typographical errors or omissions may occur in product details, prices, promotions, shipping charges, or availability. We may correct errors and update information. If an error materially affects an order you have placed, we will take appropriate steps and contact you where reasonably practicable. We will not use this section to remove rights that apply to you under law.

Section 13 — Acceptable use

You may use the Services only for lawful purposes. You must not use the Services to commit fraud, violate applicable law, infringe intellectual-property or privacy rights, transmit malicious code, interfere with site security, disrupt other users, submit knowingly false information, or send unsolicited spam through our Services.

You must not attempt unauthorized access to our systems or collect other users’ personal information without a lawful basis. We may restrict or suspend access where reasonably necessary to protect the Services, customers, or our business, subject to applicable law.

Section 14 — Suspension and termination

We may suspend or restrict access to all or part of the Services where reasonably necessary for security, suspected fraud or abuse, legal compliance, or operational reasons. Where appropriate and practicable, we will provide notice. Termination does not remove rights or obligations that arose before termination, including rights relating to orders already placed.

To the extent permitted by applicable law, the Services are provided on an “as available” basis, and we do not guarantee that the website will always be uninterrupted, secure, or error-free. Product-specific warranties, if any, will be described with the product or in the relevant policy.

Nothing in these Terms excludes or restricts a warranty, guarantee, or consumer protection that cannot lawfully be excluded or restricted. If any disclaimer in this section conflicts with a mandatory legal right, that right will prevail.

Section 16 — Limitation of liability

To the extent permitted by applicable law, Astron Marketer will not be liable for losses that are indirect or unforeseeable and that do not arise from a breach of a legal duty owed to you. This limitation does not apply where liability cannot lawfully be limited, including any liability that applicable consumer law requires us to retain.

We do not exclude responsibility for fraud, wilful misconduct, or other matters where exclusion is prohibited by law. Nothing in these Terms limits remedies available to consumers under applicable law.

Section 17 — Indemnification

To the extent permitted by applicable law, you are responsible for losses directly arising from your unlawful use of the Services or your material breach of these Terms that causes a third-party claim. This section does not require you to indemnify us for our own unlawful conduct or for liability that cannot legally be transferred to you.

Section 18 — Severability

If a provision of these Terms is found to be invalid or unenforceable, it will be applied to the fullest extent permitted by law, and the remaining provisions will continue in effect. This will not affect any mandatory consumer rights.

Section 19 — No waiver; entire agreement

If we do not enforce a provision immediately, that does not mean we waive the right to enforce it later. These Terms and the policies expressly linked in them describe the agreement governing your use of the Services, subject to any separate terms agreed with you and any rights that apply under law.

Section 20 — Assignment

You may not transfer your rights or obligations under these Terms in a way that violates applicable law. We may transfer or assign our rights and obligations as part of a business reorganization or transfer, provided that doing so does not reduce your rights under applicable law.

Section 21 — Governing law and disputes

These Terms are governed by the laws of India. Disputes will be subject to the jurisdiction of the competent courts in Bengaluru, Karnataka, where legally permissible. This clause does not prevent a consumer from exercising any statutory right to approach a consumer commission, regulator, or other forum that has jurisdiction under applicable law.

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Where required by law, we will provide notice of material changes. Changes will apply prospectively and will not remove rights that have already accrued to you.
